”सूप बोले सो बोले छलनी क्या बोले जिसमें बहात्तर छेद देश की सबसे पुरानी और सर्वाधिक समय तक सत्तासीन रहने वाली कांग्रेस और उसकी कुछ पिछलग्गू पार्टियां धर्मनिरपेक्षता, सांप्रदायिकता, अल्पसंख्यक संरक्षण जैसे विषयों पर कुछ बोलती हैं तो सहसा ही ऊपर लिखी कहावत याद आ जाती है। वास्तव में कांग्रेस ने आजादी के पहले और आजादी के बाद इन विषयों को लेकर जो चरित्र प्रस्तुत किया क्या उसके चलते उसे इन विषयों पर किसी से भी कुछ भी कहने का अधिकार है?
वर्तमान की बात करें तो कांग्रेस सहित देश के कुछ तथाकथित धर्मनिरपेक्षतावादी राजनैतिक दल गोरखपुर से भाजपा के सांसद योगी आदित्यनाथ के बयानों को लेकर हायतौबा मचाए हुए हैं। आगे बढऩे से पहले इन बयानों पर नजर डालना बेहद आवश्यक है।
yaकहते हैं कि मुसलमानों की संख्या जहां भी 10 प्रतिशत से ज्यादा है, वहां दंगे होते हैं। जहां इनकी संख्या 35 फीसदी से ज्यादा है वहां गैर मुस्लिमों के लिए कोई जगह नहीं है। एक अन्य बयान में आदित्यनाथ कहते हैं कि अगर वह हममें से एक को मारेंगे तो यह उम्मीद रखना छोड़ दें कि वह सुरक्षित रहेंगे। अगर वह शांति से नहीं रहते हैं तो हम उन्हें सिखाएंगे कि शांति से कैसे रहा जाता है। हमले और धर्मान्तरण के मामले में हिन्दू समुदाय मुसलमानों को अब जैसे को तैसा के अंदाज में जवाब देगा। संन्यासी के तौर पर मैं ऐसी असुर शक्तियों को दंडित कर सकता हूं। यदि मेरे एक हाथ में माला है तो दूसरे में भाला है।
लव जिहाद पर बोलते हुए योगी आदित्यनाथ ने कहा था कि लव जिहाद के जरिए देश को मुस्लिम राष्ट्र बनाने का षड्यंत्र चल रहा है। उन्होंने कहा था कि अगर देश में आपको रहना है तो भारतीय संस्कृति और सभ्यता का सम्मान भी करना पड़ेगा। एक अन्य वीडियो में योगी आदित्यनाथ यह कहते दिखाई देते हैं अगर वो प्रेम जाल में फंसाकर एक हिन्दू लड़की का धर्म परिवर्तन कराते हैं तो हम उनकी सौ लड़कियों को हिन्दू बनाएंगे। योगी आदित्यनाथ ने जो कुछ कहा वास्तव में वह कितना सच है अथवा कितना गलत, कितना सांप्रदायिक है अथवा कितना धर्मनिरपेक्ष सवाल यह नहीं है। सवाल तो सबसे बड़ा यह है कि स्वयं को धर्मनिरपेक्ष कहने वाली कांग्रेस और समाजवादी जैसे राजनीतिक दलों के नेताओं के पेट में इससे मरोड़ क्यों उठ रही है? वे योगी के बयानों को उत्तरप्रदेश में होने वाले उपचुनावों से जोड़कर बवाल क्यों मचा रहे हैं?
जो लोग ऐसा कर रहे हैं उनसे पूछा जाना चाहिए कि क्या कांग्रेस ने कभी इस तरह के बयान नहीं दिए? क्या कांग्रेस ने मुस्लिम तुष्टीकरण के चलते देश के करोड़ों हिन्दुओं की भावनाओं को आहत नहीं किया? यहां हम कुछ ऐसे उदाहरण प्रस्तुत करेंगे जिनसे यह सिद्ध होता है कि योगी आदित्यनाथ ऐसे बयान देने को क्यों मजबूर हुए। इतना ही नहीं इससे यह भी सिद्ध होता है कि कांग्रेस को योगी के बयान पर तनिक भी बवाल मचाने का नैतिक अधिकार नहीं है।
सबसे पहला उदाहरण उस कांग्रेस नेता का है जिसने लगातार दस वर्षों तक इस देश के प्रधानमंत्री पद की कुर्सी संभाले रखी। पूर्व प्रधानमंत्री डॉ. मनमोहनसिंह ने इस पद पर काबिज रहते एक सार्वजनिक कार्यक्रम में बोलते हुए कहा था कि इस देश के सभी संसाधनों पर पहला हक इस देश के अल्पसंख्यकों अर्थात मुसलमानों का है। एक प्रधानमंत्री का यह तुष्टीकरण भरा बयान आखिर क्या इंगित करताहै?
बात यहीं समाप्त नहीं होती जरा याद करिए कांग्रेस के जयपुर अधिवेशन को यहां कांग्रेस के वरिष्ठ नेता और देश के तत्कालीन गृहमंत्री सुशील कुमार शिंदे ने हिन्दुओं पर जो निशाना साधा था वह कितना निदंनीय और घृणित था शिन्दे ने हिन्दुओं के लिए भगवा आतंकवादी शब्द का इस्तेमाल करके कांग्रेस की हिन्दू विरोधी मानसिकता को पूरी दुनिया के सामने उजागर किया था।
यहां कांग्रेस के दिग्गज नेता और पार्टी महासचिव दिग्विजय सिंह के मुस्लिम तुष्टीकरण और हिन्दू विरोधी मानसिकता का जिक्र करना भी प्रासंगिक होगा। दिग्विजय सिंह ने एक तरफ मुस्लिम तुष्टीकरण में बाटला हाउस एनकांउटर को फर्जी ठहराया था। और इसमें मारे गए आतंकवादियों के घर जाकर आंसू भी टपकाए थे। दिग्गीराजा के मुस्लिम प्रेम के  उदाहरण यहीं समाप्त नहीं होते पूरे देश ने टेलीविजन पर यह देखा है कि दिग्विजय सिंह ने ओसामा और हाफिज जैसे आतंकवादियों को किस प्रकार ‘जीÓ लगाकर आदर दिया था। कांग्रेस नेताओं के यह तो चंद किस्से ही हैं यदि पूरा इतिहास खंगाला जाए तो नेहरू से लेकर मनमोहन तक पूरी कांग्रेस अपने शासन काल में मुस्लिम वोट बैंक को अपनी तरफ करने के लिए इस देश के मूल निवासी हिन्दुओं के साथ छल-कपट की राजनीति करती रही और हिन्दू तथा हिन्दुत्व के खिलाफ जहर उगलती रही। ऐसी कांग्रेस को यदि योगी आदित्यनाथ के बयान सांप्रदायिक नजर आ रहे हैं तो यह देखकर बेहद आश्चर्य होता है।
योगी आदित्यनाथ के जिस बयान पर कांग्रेसी सहित इस देश के तथा कथित धर्मनिरपेक्षता वादी सर्वाधिक विधवा विलाप कर रहे हैं उसमें योगी ने कहा कि जहां मुस्लिम आबादी बढ़ती है दंगे वहीं होते हैं?
डॉ.पीटर हैमण्ड की पुस्तक ”स्लेवरी टेररिज्य एण्ड इस्लाम-द हिस्टोरिकल रुट्स एण्ड कण्टेम्पररी थे्रट तथा लियोन यूरिस की पुस्तक ”द हज ÓÓका अध्ययन करने पर मुस्लिम जनसंख्या को लेकर किए गए अध्ययन पर चौकानें वाले तथ्य सामने आते हैं जिनसे योगी आदित्यनाथ के बयान में कही बात को बल मिलता है। इन पुस्तकों के मुताबिक जब तक किसी देश में अथवा क्षेत्र में मुस्लिम आबादी 2 प्रतिशत के आसपास होती है, तब वे एकदम शांतिप्रिय कानून पसंद अल्पसंख्यक बनकर रहते हैं। जैसे कि अमेरिका में 0.6, आस्टे्रलिया में 1.5, कनाडा में 1.9, चीन में 1.8, इटली 1.5 तथा नार्वे में 1.8 प्रतिशत। जब मुस्लिम जनसंख्या 2 से 5 के बीच पहुंच जाती है तब वे अन्य धर्माविलंबियों में अपना धर्मप्रचार शुरू कर देते हैं, जिनमें अक्सर समाज का निचला तबका और अन्य धर्मों से असंतुष्ट हुए लोग होते हैं जैसे कि डेनमार्क में 2 प्रतिशत, जर्मनी में 3.7, ब्रिटेन में 2.1, स्पेन में 4 और थाइलैण्ड में 4.6 प्रतिशत।
मुस्लिम जनसंख्या के 5 प्रशित से ऊपर हो जाने पर वे अपने अनुपात के हिसाब से अन्य धर्माविलंबियों पर दबाव बढ़ाने लगते हैं और अपना प्रभाव जमाने की कोशिश करने लगते हैं। उदाहरण के लिए वे सरकारों व शॉपिंग माल पर हलाल का मास रखने का दबाव बनाने लगते हैं। वे कहते हैं कि हलाल का मांस न खाने से उनकी धार्मिक मान्यताएं प्रभावित होती हैं। इस कदम से कई पश्चिम देशों में खाद्य वस्तुओं के बाजार में मुस्लिमों की तगड़ी पैठ बनी उन्होंने कई देशों के सुपर-मार्केट के मालिकों को दबाव डालकर हलाल का मांस रखने को बाध्य किया। दुकानदार भी धंधे को देखते हुए उनका कहा मान लेता है अधिक जनसंख्या का फैक्टर यहां से मजबूत होना शुरू हो जाता है। ऐसा जिन देशों में हो चुका वह हैं। फ्रांस जहां मुस्लिम 8 प्रतिशत, फिलीपीन्स 6 प्रतिशत, स्वीडन 5.5, स्विटजरलैण्ड 5.3, नीदरलैंड 5.8तथा त्रिनिदाद और टौबेगो 6 प्रतिशत।
इस बिन्दु पर आकर मुस्लिम सरकारों पर यह दबाव बनाने लगते हैं कि उन्हें उनके क्षेत्रों में शरीयत कानून के मुताबिक चलनेे दिया जाए। जब मुस्लिम जनसंख्या 10 प्रतिशत से अधिक हो जाती है तो वे उस देश, प्रदेश, राज्य अथवा क्षेत्र विशेष में कानून व्यवस्था के लिए परेशानी पैदा करना शुरू कर देते हैं। शिकायतें करना शुरू कर देते हैं। छोटी -छोटी बातों पर विवाद दंगे, तोडफ़ोड़ पर उतर आते हैं। चाहे वह फ्रांस के दंगे हों, डेनमार्क का कार्टून विवाद हो या फिर एस्टर्डम में कारों का जलाना हरेक विवाद को समझबूझ बातचीत से खत्म करने के बजाए और बढ़ाया जाता है। जैसे कि गुयाना में 10 प्रतिशत मुस्लिम, इसराइल में 16 प्रतिशत, केन्या में 11 प्रतिशत और रुस मुस्लिम आबादी 15 प्रतिशत के कारण हुआ।
जब मुस्लिम जनसंख्या 20 प्रतिशत से ऊपर हो जाती है तब विभिन्न सैनिक शाखाएं जिहाद के नारे लगाने लगती हैं असष्णुता और धार्मिक हत्याओं का दौर शुरू हो जाता है। जैसे इथोपिया में 32 प्रतिशत भारत में 22 प्रतिशत।
मुस्लिम जनसंख्या के 40 प्रतिशत के ऊपर पहुंच जाने पर बड़ी संख्या में सामूहिक हत्याएं, आतंकवादी कार्रवाइयां चलने लगती हैं। जैसे बोस्निया में 40 प्रतिशत चांड में 54.2 प्रतिशत, लेबनान में 59 प्रतिशत। जब मुस्लिम जनसंख्या 60 प्रतिशत से ऊपर हो जाती है तब अन्य धर्मावलंबियों का जातीय सफाया शुरू किया जाता है उदाहरण (भारत का कश्मीर)जबरिया मुस्लिम बनाना, अन्य धर्मों के धार्मिक स्थल तोडऩा जजिया जैसा कोई अन्य कर वसूलना आदि किया जाता है जैसे अल्वानिया में 70 प्रतिशत, मलेशिया में 62 प्रतिशत कतर में 78 प्रतिशत और सूडान में 75 प्रतिशत। जनसंख्या के 80 प्रतिशत से ऊपर हो जाने के बाद सत्ता शासन प्रायोजित जातीय सफाई की जाती है। सभी प्रकार के हथकंडे अपनाकर जनसंख्या को 100 प्रतिशत तक ले जाने का लक्ष्य रखा जाता है। जैसे बांग्लादेश 83 प्रतिशत, मिस्त्र 90 प्रतिशत, गाजा पट्टी 98 प्रतिशत, ईरान, ईराक, जॉर्डन, मोरक्को, पाकिस्तान, सीरीया आदि।
मुस्लिम जनसंख्या 100 प्रतिशत यानी कि दार-ए इस्लाम होने की स्थिति में वहां सिर्फ मदरसे होते हैं और सिर्फ कुरान पढ़ाई जाती है और इसे अंतिम सत्य माना जाता है। जैसे अफगानिस्तान, सउदी अरब, सोमालिया, यमन आदि।
यदि इन आंकड़ों को तथ्थों को सही मान लिया जाए तो भारत में मुस्लिम जनसंख्या 22 प्रतिशत हो जाने की स्थिति बेहद गंभीर कही जा सकती है। ऐसे हालात में योगी आदित्यनाथ के बयान पर हाय तौबा मचाने के बजाए इस स्थिति पर गंभीरता से विचार की जरुरत है। रही बात कांग्रेस की तो उसके लिए यही कहा जा सकता है रस्सी जल गई पर बल नहीं गए।

A story of destructive governance and citizens who did not speak out

First, the UPA came for the roads sector. They destroyed contracting. They slowed down road construction. They left highways half built. We did not speak out. After all, the only reason the NDA could have started the golden quadrilateral is because they wanted to spread Hindutva.

Next, they came for the airline sector. They let Air India suck more money from taxpayers. They let bad regulation destroy the private sector. They let crony banking sustain bad bets. They ensured India would never be an aviation hub. We did not speak out. After all, flying is what birds do, not humans. Besides, aviation is bad for climate change.

Then they came for the power sector. They confused creation of mega capacities with actual generation. They had no rational pricing plans. They were arbitrary in the awarding of licences. They could not make up their mind whether they wanted to protect the environment or destroy it. We did not speak out. After all, the only power that matters is political. Electricity be damned.

Then they came for education. They promulgated the RTE after 100 per cent enrolment. They expanded capacity, but cut-offs still rose. They regulated in such a way that there was a glut in some subjects and a shortage in others. They confused university buildings with building universities. We did not speak out. After all our, our low quality education left us incapable of speaking out.

Then they came for industry. They turned the clock back in every way and waged open war. Ensure that regulations become more complex and uncertain. Ensure that input costs rise. Ensure crummy infrastructure. Promulgate a land scam policy known as SEZ and sell it as industrial policy. They encouraged FDI. But they forgot which one they wanted: outbound or inbound. But we did not speak out. After all, India is a rural country.

Then they came for employment. There was some growth. But they decided that the only good employment is that which has the hand of the state. So the NREGA’s expansion was seen as a sign of success, not failure. By its own logic, if more people need the NREGA, the economy has failed. But we did not speak out. After all, the more people we have dependent on government, the more we think it is a good government.

Then they came for agriculture. First, they create artificial shortages through irrigation scams. Then they have a myopic policy for technology adoption. Then they decide India shall remain largely a wheat and rice economy; we will have shortages for everything else. Then they price everything to produce perverse incentives. But we did not speak out. After all, why worry about food production when the government is giving you a legal right? Is there anything more reassuring than social policy designed by and for lawyers?

Then they came for institutions. They always had. This has been Congress DNA for four decades. They drew up a list of institutions that remained unscathed: Parliament, the IB, bureaucracy and you name it. They then went after those. They used institutions as instruments of their political design. They demoralised every single branch of government. But we did not speak out. After all, this was reform by stealth. Destroy government from within.

Then they came for inflation. They confused a GDP target of 10 per cent with an inflation target. Inflation will come down next quarter, we were told. Then they tried to buy us out. Inflation: no problem. Simply get the government to spend even more. Then they pretended inflation is a problem for the rich. Then they simply stopped talking about it. We did not speak out. After all, for some, inflation is just a number

Then they came for the telecom sector. They got greedy and milked it. They got arbitrary and retrospectively taxed it. But we did not speak out. After all, new communication can be a threat to government. Besides, we can always revert to fixed lines. More digging is good.

Then they came for financial stability. They produced a large deficit. They brought the current account deficit close to an unsustainable point. They nearly wrecked the banking sector. They created every macro-economic instability you can imagine, which makes investment difficult. But we did not speak out. After all, what would you rather have: macro economic stability or a free lunch?

Then they came for regulation. It was back to the 1970s. More arbitrary regulation is good. More rules are good. Uncertainty makes business more adept. The answer to every administrative problem is enacting a new law. Multiple regulators are good because they represent the diversity of India. We did not speak out. After all, just like the religious confuse piety with mere ritual, the virtuous confuse regulation with outcomes.

Then they came after freedom. They promulgated more restrictive rules for everything: freedom of expression, right to assembly and protest, foreign scholars. They used sedition laws. They kept the architecture of colonial laws intact. They said they stood against communal forces. But then they let Digvijaya Singh keep the communal pot boiling. They matched BJP’s communal politicisation of terrorism at every step and then some. We did not speak out. After all, if they are not Hindutva forces, they cannot be a threat to peace and liberty.

Then they came for virtue itself. They preached, from the very summit of power: avoid responsibility. It will always be someone else’s fault. They legitimised being corrupt: you are entitled to it if you are the party of the poor. They encouraged subterfuge to the point that members of the cabinet were subverting each other. They pretended that integrity is a word that does not mean anything. To independent thinkers, they said: why think when there is 10 Janpath? We did not speak out. After all, virtue and thinking can both be outsourced.

Then they came for the poor. They visited their houses and slept in their homes. They liked the experience so much they decided to become growth sceptics. Enact policies that keep India in poverty a little longer. But we did not speak out. After all, once the poor have been used as an argument, all else is immobilised.

Then they came for the citizens. They used the secularism blackmail to reduce our choices. If you are not with us you are evil they said. Then they infantilised us. You are not capable of exercising choices so we will make them for you. They acted as if we were so stupid that the three topmost leaders felt no need to justify themselves to us. But we did not speak out. After all we do have the vote.

Then they came for states. They looked at all states in the country and found out that they have pockets where they got their maximum vote share. They liked retaining them so much that they decided to break them down just on the eve of elections to maximize their gain and minimize the gain of opposition. But we are not speaking out. After all, what was India but a loose amalgamation of over 600 princely states unified into one.

Then they came for national security. They looked at all borders and neighbors of the country and told themselves that non-alignment is just another name for inaction and chose to take no decisions at all. But we did not speak out. After all, who cares about national security when personal future is not secure without any dependence on government.

Then they came for those who decided to speak out. Lathis & water cannons were used on students who protested the brutal rape of a young girl. People who requested a LokPal Bill were hounded into silence. One corrupt minister replaced another in the cabinet – with utmost disregard for people’s faith in democracy. They mistook our patience as powerlessness. After all, they know a lot of us have a very short-term memory & they will prevail come 2014.

Ask policy planners in Uttarakhand the need for so many dams to be constructed in the State, and they will tell you the structures are necessary for power generation and prosperity. But the policy has backfired terribly

This March, I had the occasion to visit Srinagar, Garhwal. There I witnessed some of the immediate consequences of building cascades of dams for the pecuniary benefits of the State (read, local officials). When I argued, “Why were there so many dams? I was told that, if the Union Government does not go for dams and generate power, it would have to annually release Rs 10,000 crore to Rs 15,000 crore as Central assistance. The Union Government wants power and the State, hard cash; dams bring a win-win situation. But what about the rivers which, at some places, have started disappearing?

Projects currently underway were supposed to increase the hydro-power capacity of the State to 12,235MW. A total of 95 hydro-power projects were being built or planned on different rivers converging in the Alaknanda and Bhagirathi basin of Uttarakhand.  Nobody really cared if environmentalists like former IIT professor GD Agrawal or before him Sunderlal Bahuguna were opposing the wild contagion of concrete infrastructures. They were labeled ‘anti-development’; ‘development’ being the new god of the Himalayas.

It is not that the officials were unaware that since 2005, when Tehri dam’s reservoir filled up, the flow of the Bhagirathi had reduced drastically. I then wrote a note: “When there will no more rivers to worship, no more jobs for the local population, people will have to migrate to the cities.” My friend Michel Danino’s book, The Lost RiverOn the Trail of the Sarasvati, is a mind-opener on the fate of the mythic Saraswati river. Taking into account the latest research in fields as different as satellite imagery, archeology, linguistics, paleontology or mythology, Danino has explained: “The Indian subcontinent was the scene of dramatic upheavals a few thousand years ago. The Northwest region entered an arid phase, and erosion coupled with tectonic events played havoc with river course. One of them (the Sarasvati) disappeared.” Now, humanity has progressed; it can build its own tectonic events!

After the June 16 torrential rains, we have not lost rivers (though the course of some have changed), but in several cases the wild construction of dams has triggered much more destruction, increasing the misery of the locals. A few days after the downpour, The Hindu reported: “The national highway between Dehradun and Srinagar [Garhwal] is currently broken at Byasi and Devprayag, with silt measuring upto 10 ft covering an enormous area, in Uttarakhand’s Pauri district. According to the residents of Shakti Vihar, an area in Srinagar, this disaster occurred on June 17 at around 3am when the Srinagar dam authorities lifted the dam gates.” A resident told the newspaper: “The rainfall on June 16 was so much that the water reached up to our knees, and to add to it, the dam authorities released water without a prior warning.” Did they panic? Enquiries, if any, will tell us. The water from upstream swept the debris lying around the dam construction site and deposited a huge amount of silt tens of kilometers downstream. The water level was three to four metres higher than any previous floods.

The question asked by each commentator was: Was it predictable? In 2009, after studying the hydro-electric projects in Uttarakhand, a State Audit of the Comptroller and Auditor-General explained: “With the creation of Uttarakhand in November 2000, its hydro-power potential was recognised as key to the development of the State. The Government chalked out an ambitious plan to harness its hydro-power potential through the concerted efforts of both the State and the private sector.” A State policy was formulated in October 2002; with the dams, the needs of the State but also those of the ‘starved northern grid’ could be taken care of. According to the CAG report, most of the projects faced problems associated with land acquisition, forest clearances and enhancement in project capacities. But did anybody read the report? Certainly not the planners and their contractors — they were too busy making money. Indeed, ‘dam is money’, whether in Uttarakhand, in Sikkim or in Arunachal Pradesh.

The CAG had warned: “The State’s policy on hydro-power projects was silent on the vital issue of maintaining downstream flow in the diversion reach, …physical verification of four out of five operational projects, showed that river-beds downstream had almost completely dried up.” A new Saraswati in the making! The Auditors also remarked: “Negligence of environmental concerns was obvious as the muck generated from excavation and construction activities, was being openly dumped into the rivers contributing to increase in the turbidity of water.” It has now happened on a large scale after the June 16 and 17 torrential rains.

ForThe Hindu article, a resident told the reporter: “Though residents were saved, cattle were killed under the silt. Quintals of fish that the river brought along are also rotting under the debris.” It appears that every person passing by the site could smell the rotten flesh. The CAG had concluded: “The individual and cumulative impact on the downstream river flow should be seriously considered to ensure that the projects do not result in disastrous impact on the environment.” Now, it is too late. Yet, it was supposed to be a win-win situation!

As information triggers through about the Himalayan devastation, news of the Vishnuprayag Hydro-electric Project was posted on the blog of two well-known environmentalists, Vimalbhai and Briharshraj Tadiyal. Remember, Vishnuprayag is one of the Panch Prayags (five confluences) of the Alaknanda river, and lies at the confluence of Alaknanda and Dhauliganga between Joshimath and Badrinath. It is located in Chamoli district of Uttarakhand. According to legend, Rishi Narada had a vision of Vishnu while meditating there. Of course, all this is not real, it is only mythology. Concrete alone is real nowadays. The environmentalists wrote: “When the waters rose, dam authorities failed to open all the gates of the dam. Due to this, a two km long reservoir was formed upstream of the dam. Pressure from the water broke the dam and went on to wipe out the Lambagad village market.” In 2012 already, some shops in Lambagad had been washed away when water was released inadvertently by the dam authorities. This time, the deluge from the upper reaches of Alaknanda buried the 400 MW Vishnupyrag HEP. Will the Government of Uttarakhand continue with its dam policy? Will politicians and ‘developers’ resist getting rich quickly?

Tragically, the same situation is bound to happen, probably on a larger scale, in Sikkim and Arunachal Pradesh. And what about the string of dams being built by the Chinese on the Yarlung Tsangpo (Siang/Brahmaputra) in Tibet? And if China constructs its purported mega-dam, where will the debris go? Will the situation be different on the Roof of the World than in Uttarakhand? It is probably worse due to the higher seismicity.

Has Mr Shivshankar Menon, the National Security Adviser, discussed the issue with his Chinese counterpart during their recent meeting in Beijing?”

Not ‘Secularism’ again

Now that the Chief Minister of Bihar has dragged ‘succularism’ into the political discourse, it is time to deconstruct it so that we can end this pointless debate once and for all. I have deliberately misspelt the word because when said in Hindi that is how it is usually pronounced. It is a hard word to write in devnagri and the Hindi and Urdu equivalents do not quite mean what secularism has come to mean in the Indian political context. It is a foreign word that evolved in a European context when the powers of the church and the state were separated. In India, since none of our religions were led by pontiffs who controlled armies, or had vast temporal powers, we had no need to make this separation.

But, the word secularism is used in India more than almost any other country. Why?

Well, because when we entered our current era of coalition governments, political parties of leftist disposition found it convenient to keep the BJP out of power by saying they would only ally with ‘succular phorces’. The BJP became a pariah after the Babri Masjid came down and so whenever someone like Nitish Kumar wants to hurl abuse at the party he is in alliance with in Bihar, or one of its leaders, the ‘secularism’ debate gets revived.

Currently, he appears to be positioning himself for prime minister in 2014 and seems to believe that he will only be in the running for this job if he can eliminate Narendra Modi before the race begins. He is not alone in this endeavour. On my wanderings in Delhi’s corridors of power last week, I ran into journalists and politicians who went on and on about how Modi could never be prime minister because of the violence in Gujarat in 2002.

They said pretty much what the Chief Minister of Bihar, and his cohorts, have said which is that the prime minister must be a man who is ‘clean and secular’. So how do we explain Rajiv Gandhi? How should we understand why he was given the biggest mandate in Indian parliamentary history after justifying the pogroms that killed thousands more Sikhs in 1984 than Muslims were killed in Gujarat in 2002? Were Indian voters un-secular when they gave him more than 400 seats in the Lok Sabha?

If there were still a chance of major communal riots in the future, there may have been some point to reviving this talk of secularism. But, there has not been a single major Hindu-Muslim riot since 2002 despite Muslims from next door having been responsible for the worst terrorist attack on Indian soil in 2008. Before 26/11, there were other attacks by Islamists on Hindu temples, commuter trains in Mumbai, stadiums in Hyderabad and bazaars in Delhi. None of these ugly acts of violence caused riots. Our 24-hour news channels have made communal riots impossible and the average Muslim has begun to understand this. I noticed this while travelling in Uttar Pradesh during the recent elections.

So let us stop this silly talk of secularism and communalism and start demanding from those who want to become India’s next prime minister that they tell us what they can do for this country.

Here is my own list of questions.

What will the next Prime Minister do to end the licence raj that prevents the education system from achieving its full potential? What will he do to fix our broken public healthcare system? What will he do to make sure that every Indian has enough electricity to at least light a few bulbs and run a ceiling fan in his home? What will he do to create new jobs for the estimated 13 million young Indians who enter the job market every year? What will he do to revive the Indian economy? What steps will he take to ensure that India becomes a fully developed country by the middle of this century?

When I heard Aung San Suu Kyi’s address to both houses of Britian’s Parliament in Westminster hall last week, what impressed me was the clarity with which she spelt out her vision for her country. But, throughout her speech, something kept bothering me and by the time she finished, I discovered what it was. What bothered me was that I could not think of a single Indian leader who could make such a speech.

The Indian political landscape today has become a desert in which only the stunted progeny of stunted political leaders bloom. We need our political parties to throw up real leaders and we need a political discourse in which real political problems are discussed.

So can we stop fishing ‘secularism’ out of the dustbin of history and holding it up as a shining ideal? Its relevance faded a long time ago.

In its closure report, the Special Investigation Team (SIT) has clearly expressed an opinion that “certain vested interests including Shri Sanjiv Bhatt, different NGOs, and some political leaders were trying to use honorable Supreme Court/SIT as a forum for settling their scores”. The SIT has in its report noted that “Shri Sanjiv Bhatt had been colluding with the persons with vested interests to see that some kind of charge-sheet is filed against Shri Narendra Modi and others.” The report has quoted some email communications of Sanjiv Bhatt that clearly make a point that Bhatt had attempted to influence Amicas Curiae through NGOs, media campaign and pressure groups.

The SIT in it report says: Government of Gujarat vide its letter dated 22-6-2011 forwarded a set of emails exchanged between Shri Sanjiv Bhatt, DIG, Gujarat Police and certain individuals during April and May 2011. It was mentioned in the above letter that during the course of an inquiry instituted against Shri Sanjiv Bhatt, IPS by DG (Civil Defense), Gujarat regarding misuse of official resources, some revelations have been made having direct bearing on the cases being monitored by SIT. The material forwarded by Govt. of Gujarat has been scrutinized and the salient features of the same are summarized as below:

(1) That top Congress leaders of Gujarat namely Shri Shaktisinh Gohil, Leader of Opposition in Gujarat Legislative Assembly and Shri Arjun Modhwadia, President of Gujarat Pradesh Congress Committee are in constant touch with Shri Sanjiv Bhatt, DIG. They are providing him ‘packages’, certain materials and also legal assistance. Further, on 28-04-2011 Shri Sanjiv Bhatt exchanged mails with Shri Shaktisinh Gohil and the former gave point for arguments in honorable Supreme Court matter, allegations to be made against the members of SIT and to establish that the burning of a coach of a Sabarmati Express at Godhra railway station was not a conspiracy. From the emails, it appears that Shri Sanjiv Bhatt was holding personal meetings with senior mentions that he was ‘under exploited’ by the lawyer representing Congress before Nanavati Commission of inquiry.

2. That Shri Sanjiv Bhatt had been persuading various NGOs and other interested groups to influence the Ld. Amicus Curiae and the honorable Supreme Court of India by using ‘media card’ and ‘pressure groups’.

3. Shri Sanjiv Bhatt had been exchanging emails with one Nasir Chippa and in the email dated 11-5-2011 Shri Bhatt has stated that he (Nasir Chipa) should try to mobilize support/pressure-groups in Delhi to influence Ld. Amicus Curiae Shri Raju Ramchandran in a very subtle manner. In another email dated 18-5-2011, Shri Sanjiv Bhatt had requested Shri Nasir Chippa to influence Home Minister Shri P.Chidambaram through pressure groups in U.S. It is believed that Shri Nasir Chippa has strong U.S. connections and his family stays there.

4. That Shri Sanjiv Bhatt arranged an appeal from Shri M.Hassan Jowher, who runs a so called NGO titled SPRAT(Society for Promoting Rationality) to Amicus Curiae on 13-5-2011, to call Shri Sanjiv Bhatt, IPS, Shri Rajnish Rai, IPS, Shri Satish Verma, IPS, Shri Kuldeep Sharma, IPS and Shri Rahul Sharma, IPS (all police officers of Gujarat) to tender their version of the Gujarat story. It may be mentioned here that the draft for the said appeal was sent by Shri Sanjiv Bhatt himself to Shri Jowher, Further, a copy of this mail was circulated by Shri Sanjiv Bhatt to Ms. Shabnam Hashmi, Ms. Teesta Setalwad, Shri Himanshu Thakker, journalist, Shri Leo Saldana, journalist and Shri Nasir Chippa to encourage the prominent persons/organizations to write to Amicus Curiae on the similar lines so as to pressurize him.

5. In emails exchanged on June 1, 2011 between Shri Sanjiv Bhatt and Shri M.H.Jowher, it was proposed that a PIL may be field through a lawyer named Shri K.Vakharia( a senior advocate and chairman of legal cell of Congress party in Gujarat) in the Gujarat High Court for providing security to Shri Sanjiv Bhatt. It was also proposed that another complaint may be filed with the Commissioner of Police, Ahmedabad city against Shri Narendra Modi and others for his alleged involvement in 2002 riots which would be taken to appropriate judicial forums in due course.

6.That Ms. Teesta Setalwad, her lawyer Shri Mihir Desai and Journalist Shri Manoj Mitta of Times of India were in constant touch with Shri Sanjiv Bhatt, IPS and were instrumental in arranging / drafting of the affidavit for filing the same in honorable Supreme court. Vide email dated 10-4-2011, Shri Bhatt solicited “Co-ordinates” from Ms. Teesta Setalwad, who had also arranged for a meeting with her lawyer Shri Mihir Desai at Ellis bridge Gymkhana, Ahmedabad. Shri Sanjiv Bhatt sent the first draft of his proposed affidavit to Shri Manoj Mitta on 13-4-2011, after meeting Shri Mihir Desai, Advocate and invited his suggestions. Shri Manoj Mitta advised Shri Sanjiv Bhatt to incorporate a few more paragraphs drafted by him which were incorporated by Shri Sanjiv Bhatt in his final affidavit sent to honorable Supreme Court of India as suggested by Shri Mitta.

7. That Shri Sanjiv Bhatt was instrumental in arranging an affidavit of one Shri Shubhranshu Chaudhary, a journalist, to corroborate his claim that he had gone to attend a meeting called by the Chief Minister at his residence in the night of 27-2-2002. Significantly, Shri Bhatt had sent his mobile phone details of 27-2-2002 to Shri Shubhranshu Chaudhary and had also suggested that probable timings of his meeting to Shri Shubhranshu Chaudhary on 15-5-2011. Simultaneously, these details were sent to Ms. Teesta Setalwad on 16-5-2011, for drafting the document, presumably the affidavit to be filed by Shri Shubhranshu Chaudhary. Shri Sanjiv Bhatt sent an email to Shri Shubhranshu Chaudhary that the said affidavit could be leaked out to the print media which would force the Amicus Curiae and honorable Supreme Court to take notice of the same. Shri Sanjiv Bhatt also sent another email to Shri Shubhranshu Chaudhary, in which he has stated that they should play the ‘media trick’ so that affidavit is taken seriously by Amicus Curiae and the honorable Supreme Court.

8. That Shri Sanjiv Bhatt had been exchanging emails with one Leo Saldana, a Narmada Bachao Andolan activist, with a view to mobilize public opinion in their favor. On 1-5-2011, Shri Sanjiv Bhatt had sent an email to the latter to the effect that what they needed to do at this stage was to create a situation, where it would be difficult for three judges Supreme Court bench to disregard the ‘shortcomings of SIT under stewardship of Mr. Raghavan’ and that the pressure groups and opinion makers in Delhi could be of great help in forwarding the cause. He has further stated in the mail that he was hopeful that things would start turning around from the next hearing, if proper pressure was maintained at national level.

9.That Shri Sanjiv Bhatt was trying to contact Shri K.S.Subramanyam, a retired IPS officer, through Shri Nasir Chippato make an affidavit supporting his stand with a view to convince the Amicus Curiae and through him the honorable Supreme Court of India that Shri K.Chakravarthi, former DGP of Gujarat, was a liar.

10. That Shri Sanjiv Bhatt had been taking advice of Ms. Teesta Setalwad in connection with his evidence before Nanavati Commission of inquiry. He had also been in touch with various journalists, NGOs and had been forwarding his representations, applications and other documents through email, whereas on the other side he had been claiming privilege that being an intelligence officer he was duty bound not to disclose anything unless, he was legally compelled to do so.

11. That Shri Sanjiv Bhatt had been maintaining a close contact with Shri Rahul Sharma, DIG of Gujarat Police and had been getting his mobile phone calls analyzed with a view to ascertain his own movements of 27-2-2002. This shows that Bhatt does not recollect his movements on that day. He has also been trying to ascertain the movements of Late Haren Pandya, the then minister of state for Revenue on 27-2-2002, with a view to introduce him as a participant of the meeting of 27-2-2002 held at CM’s residence, but could not do so, as Shri Rahul Sharma had informed him after the analysis that there was absolutely no question of Late Haren Pandya being at Gandhinagar on 27-2-2002 night.

From the study of emails, it appears that certain vested interests including Shri Sanjiv Bhatt, different NGOs, and some political leaders were trying to use honorable Supreme Court/SIT as a forum for settling their scores.This would also go to show that Shri Sanjiv Bhatt had been colluding with the persons with vested interests to see that some kind of charge-sheet is filed against Shri Narendra Modi and others.

RIP Congress- Let us work hard to make this a reality

 

Ram Jethmalani tears apart arguments of Delhi Police in Ramlila Maidan incident case

Noted lawyer Ram Jethmalani today blasted Delhi Police in a case relating to Delhi Police crackdown on Baba Ramdev and his supporters during the intervening night of 4th and 5th June 2011. While arguing for Baba Ramdev’s trust, Jethmalani tore apart claims of Delhi Police that if they had not taken any action, it could have led to the communal tensions in the area. In a hearing which lasted for two hours, the veteran criminal lawyer tried to pursue the judges that Delhi Police violated the provisions of Criminal Procedure Code.Starting his arguments before the bench of Justice B S Chauhan and Justice Swatantra Kumar, Jethmalani said “.fasting and meditation are two elements of Yoga and the word used for fasting is Anshan. Swami Ramdev had declared that he was fasting for a cause of bringing back black money stashed abroad. Up to 3rd of June, Ramdev was a revered personality, not only by millions, but also by the ministers of the Government. Even the Prime Minister complemented him for his suggestions. All that turned out to be hoax and after 4th June Swamy Ramdev became a criminal…”Jethmalani also informed the court that the owner of the property that is Ramlila Maidan is Municipal Corporation of Delhi. According to Jethmalani “..Use of this property doesn’t depend upon the permission from the Delhi Police, they could neither grant permission, nor could they refuse it. There is no rule under which I could be asked to take permission. It is part of the Indian tradition to hold meetings at public places…”Ram Jethmalani informed the court that the Police had imposed three conditions on Baba Ramdev for holding his Yoga camp. These three conditions were (1) You will have to take permission from the owner of the property; (2) Make sure that you don’t obstruct the free flow of the traffic in the area and (3) Depute sufficient number of volunteers at the venue.

“…There was no breach of any of the conditions, action of Delhi Police was an act of Criminal Intimidation, it was a show of Criminal Force. Men, women and children were sleeping; Delhi Police own affidavit says that Baba Ramdev himself was sleeping. This crowd went to sleep after the Shanti Paath and they had nothing to do with the traffic. Whoever woke them up is guilty of culpable homicide of the poor lady Rajbala who lost her life.Look at the shamelessness, the records show that the people were injured due to stampede and they did not have Lathis, these are monstrous lies…” argued Jethmalani.

Refuting the claims of Delhi Police that Ramdev followers had brought bricks at the venue, Jethmalani said that the bricks were brought for constructions of temporary toilets at the venue. “…the guardians of law who entered to restore the law and order were seen trowing showers of bricks on the Kutia (कुटिया ) of Baba Ramdev. They called us unlawful assembly but in this case, it was the police which formed unlawful assembly…” argued Jethmalani.

Attacking the order under Section 144 of CrPC, Jethmalani came down heavily on the language of the order. Tearing apart the contents of the order which suggested that some people or groups wanted to disturb the peace and tranquility in the area, Jethmalani argued, “…you are bound to tell under section 144 the facts, you cant just say there are “some” people who are going to create disturbance. In a way, the followers of Ramdev would have thought that they are the ones who are going to be attacked. Suggesting the entire area as a communally sensitive area is a slur on the Muslim population there…”

Concluding his arguments for the day, Jethmalani informed the bench that the police was required to give adequate notice to people before resorting to any action and if the people did not cooperate only then the police could have taken any action. The court posted the matter for further hearing for 4th November.
